TEAMMARKETER SCHOOL WEBSITE PACKAGE

TERMS AND CONDITIONS

1. INTRODUCTION

These Terms and Conditions govern the provision of website design, domain registration, hosting, email hosting, and related services by TeamMarketer (“the Service Provider”) to the Client (“the School”).

By accepting a quotation, making payment, or requesting commencement of work, the School agrees to be bound by these Terms and Conditions.

2. PACKAGE DETAILS

The School Website Package includes:

  • Website design and development based on a pre-approved TeamMarketer website template.

  • Domain registration (subject to availability).

  • Website hosting.

  • Two (2) business email addresses linked to the registered domain.

  • Website maintenance required to keep the website operational.

  • Monthly hosting and website service subscription.

Pricing

  • Once-off Setup Fee: R500

  • Monthly Premium: R299 per month

The setup fee and first month’s premium must be paid in full before development commences.

3. DOMAIN REGISTRATION

The package includes registration of one domain name, subject to availability through the applicable domain registrar.

The domain extension will be one of the following:

  • .co.za

  • .online

  • .site

TeamMarketer cannot guarantee the availability of any specific domain name.

If the School’s preferred domain name is unavailable, alternative domain names must be selected by the School.

The registered domain remains linked to the active service agreement and subscription.

4. WEBSITE DESIGN AND DEVELOPMENT

The website will be developed using TeamMarketer’s standard school website template (see mockup below)

The package includes only the pages and sections specifically included within the selected template.

The School acknowledges that:

  • The website is not a custom-developed website.

  • The website will closely follow the template structure, layout, and functionality.

  • TeamMarketer reserves the right to maintain consistency with the template design.

  • Design changes outside the standard template are not included in this package.

5. PROJECT TIMELINES

Development will commence once:

  1. The setup fee has been paid.

  2. The first month’s premium has been paid.

  3. The required content has been supplied by the School.

  4. The selected domain has been successfully registered.

Development typically takes approximately seven (7) business days after all required information and payments have been received.

Delays caused by missing content, delayed approvals, or delayed responses from the School may extend delivery timelines.

6. CONTENT SUPPLIED BY THE SCHOOL

The School is responsible for supplying all content required for the website, including but not limited to:

  • School information

  • Mission and vision statements

  • Contact details

  • Admission information

  • Logos

  • Images

  • Social media links

TeamMarketer will not be responsible for creating, sourcing, researching, or generating content unless specifically agreed in writing and quoted separately.

The School warrants that all supplied content:

  • Is accurate.

  • Is owned by the School or properly licensed.

  • Does not infringe any third-party rights.

The School indemnifies TeamMarketer against any claims arising from supplied content.

7. SCOPE OF WORK AND SCOPE CREEP

This package is strictly limited to the template website structure and functionality offered by TeamMarketer.

Any request beyond the agreed template structure shall be regarded as Scope Creep.

Examples of Scope Creep include, but are not limited to:

  • Additional pages.

  • Custom functionality.

  • Online stores.

  • Booking systems.

  • Learner portals.

  • Parent portals.

  • Additional forms.

  • Third-party integrations.

  • Custom design changes.

  • Additional content creation.

  • Additional email accounts.

Where Scope Creep occurs, TeamMarketer reserves the right to:

  • Decline the request; or

  • Provide a separate quotation for the additional work.

No additional work will commence until written approval and payment arrangements have been agreed upon.

8. WEBSITE UPDATES AND CHANGES

The package covers the initial website build only.

Future updates, modifications, additions, redesigns, content changes, or feature enhancements are not included unless expressly stated.

All future website changes may be subject to a separate quotation and additional fees.

TeamMarketer reserves the right to determine whether a requested change falls within standard support or constitutes additional work.

9. HOSTING AND EMAIL SERVICES

The monthly premium includes:

  • Website hosting.

  • Domain management.

  • Two (2) email accounts.

Additional email accounts may be available at an additional monthly fee.

The School is responsible for:

  • Managing email passwords.

  • Maintaining security of email accounts.

  • Ensuring lawful use of email services.

TeamMarketer reserves the right to suspend email services if they are used for spam, illegal activities, or activities that negatively affect server performance.

10. MONTHLY SUBSCRIPTION AND PAYMENTS

The monthly premium of R299 is payable in advance.

Invoices are payable on or before the due date indicated on the invoice.

Failure to pay by the due date may result in:

  • Suspension of the website.

  • Suspension of email services.

  • Suspension of hosting services.

  • Suspension of domain-related services.

The School remains liable for any outstanding amounts incurred prior to suspension.

11. WEBSITE SUSPENSION

The website will remain live and accessible only while the monthly premium remains paid and up to date.

Should payment not be received:

  • TeamMarketer may suspend the website without notice.

  • Email services may be suspended.

  • Hosting services may be suspended.

Service restoration may be subject to settlement of all outstanding amounts and any applicable reactivation fees.

12. TERMINATION

The School may terminate the service by providing 30 Days written notice.

Outstanding fees remain payable up to the date of termination.

TeamMarketer may terminate services where:

  • Payments remain outstanding.

  • These Terms are breached.

  • The School engages in unlawful activity.

Upon termination:

  • Hosting may cease.

  • Email services may cease.

  • Website services may cease.

  • Domain services may cease if not transferred or renewed separately.

13. INTELLECTUAL PROPERTY

The School retains ownership of all content supplied by the School.

TeamMarketer retains ownership of:

  • Website templates.

  • Design frameworks.

  • Development methodologies.

  • Proprietary systems.

  • Software configurations.

No ownership of TeamMarketer’s templates or proprietary systems is transferred to the School.

14. LIMITATION OF LIABILITY

TeamMarketer shall not be liable for:

  • Loss of profits.

  • Loss of data.

  • Business interruption.

  • Indirect damages.

  • Consequential damages.

  • Third-party service failures.

  • Domain registrar failures.

  • Hosting provider outages.

  • Internet connectivity issues.

The maximum liability of TeamMarketer shall not exceed the amount paid by the School during the preceding three (3) months.

15. FORCE MAJEURE

TeamMarketer shall not be liable for delays or failures resulting from circumstances beyond its reasonable control, including:

  • Power outages.

  • Internet failures.

  • Natural disasters.

  • Government actions.

  • Cyberattacks.

  • Labour disputes.

16. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.

17. ACCEPTANCE

Payment of the setup fee and/or monthly premium shall constitute acceptance of these Terms and Conditions.

The School acknowledges that it has read, understood, and agrees to be bound by these Terms and Conditions.
