TEAM BUILDER – Disclaimer, Disclosure & Indemnity
By participating in any activity, event, camp, excursion, fundraiser, team-building session, or programme facilitated or arranged by TEAM BUILDER (Pty) Ltd, all participants, parents, guardians, and organisational representatives acknowledge and agree to the following:
1. Assumption of Risk
Participants voluntarily engage in activities that may involve physical exertion, outdoor movement, sports, travel, games, and other dynamic exercises. These activities naturally carry risks, including but not limited to:
- Injury (minor or severe)
- Accidents or unforeseen incidents
- Illness, fatigue, or physical discomfort
- Environmental factors such as heat, cold, rain, wind, uneven surfaces, insects, or natural hazards etc.
Participants agree that they understand these risks and accept them voluntarily.
2. Indemnity
TEAM BUILDER (Pty) Ltd, its directors, staff, facilitators, partners, volunteers, contractors, and venue providers are hereby indemnified against:
- Any injury, loss, damage, or death sustained by a participant
- Any medical expenses resulting from participation
- Any theft, loss, or damage to personal property
- Any claims arising from unforeseen incidents, accidents, or participant behaviour
This indemnity applies regardless of negligence, except where prohibited by South African law.
3. Weather, Environmental & Uncontrollable Circumstances
Participants acknowledge that certain activities are dependent on weather, venue availability, and external factors outside the control of TEAM BUILDER.
TEAM BUILDER shall not be held liable for:
- Delays, interruptions, or cancellation of events due to weather conditions
- Changes to schedules, locations, or activities due to safety concerns
- Circumstances such as strikes, transport failure, venue closures, emergencies, or any force majeure event
TEAM BUILDER reserves the right to modify, postpone, or cancel an event for safety or operational reasons without being liable for compensation, except where contractually agreed.
4. Responsibility of Participants
Participants (and parents/guardians for minors) agree to:
- Follow all instructions issued by TEAM BUILDER staff
- Behave responsibly and respectfully
- Disclose any relevant medical conditions, allergies, or limitations
- Accept responsibility for actions that may cause harm to themselves or others
Failure to comply may result in removal from the activity without refund.
5. Medical & Emergency Consent
In the event of an emergency, TEAM BUILDER is authorised to:
- Secure appropriate medical assistance
- Call emergency services
- Act in the best interest of the participant
All related costs remain the responsibility of the participant, parent, or organisation.
6. Acceptance
By signing up for or participating in any TEAM BUILDER activity, the participant (or parent/guardian when applicable) acknowledges that:
- They have read and understood this Disclaimer, Disclosure & Indemnity
- They accept all terms voluntarily
- They waive any right to claim damages against TEAM BUILDER beyond what is allowed by law
